Terms & Conditions
These terms and conditions govern the Clinikally Elite Program, and form a binding agreement between you and Clinikally Digital Health Private Limited (hereby referred to as Clinikally).
If you sign up for the Elite Club membership program, you accept these terms and conditions in entirety. Additionally, your usage of any of the other services or products of Clinikally continue to be governed by their respective "Terms of Use", "Privacy policy", "Return & Cancellation Policy" and other applicable legal documents.
Membership
- Elite membership may be purchased through the Clinikally website or through the partner clinics.
- Payment for the membership may be made through online prepayment ("Prepaid”) or at the partner clinic only.
- The term of the Elite membership is 3 (three) months from the date of purchase ("Term") for Elite members.
- Elite Club Membership, once purchased, cannot be cancelled. However, cancellation is permissible only when
- It is within 24 hours of purchase and the customer has not used any Elite Benefits.
Membership Fee
The Clinikally Elite Club membership fee ("Fee") is stated on the Clinikally Elite Club membership page. The Fee charged may vary from time to time, and unless specifically stated otherwise, is inclusive of all taxes. The Fee is non-refundable and the membership may not be cancelled once purchased, except as provided within these terms.
Membership Conditions
Clinikally reserves the right to accept or refuse Elite Club membership, at its sole discretion. Elite members consent to receiving communication from Clinikally through any registered medium of communication.
- Elite membership or any benefits thereunder are not transferable.
- Elite members may not use their membership to purchase products for the purpose of resale or rental, and the Elite membership may not be used by any party to ship products to its own customers or potential customers.
Clinikally may, at its sole discretion, choose to modify the benefits provided under the Elite Club Membership.
Clinikally’s failure to insist upon or enforce strict compliance with these terms will not constitute a waiver of any of its rights.
Clinikally and its directors, employees and agents shall not be liable for any direct, indirect, special, incidental, consequential or punitive damages, or any other damages of any kind, arising out of or related to Elite Club.
Total liability for Elite, whether in contract, or otherwise, will not exceed the Fee paid. The exclusions and limitations of liability contained within these terms and in the provisions of other policies applicable to an Elite member's use of the Clinikally platform, shall apply to the fullest extent permitted under applicable law and will survive the cancellation or termination of Elite membership.
Agreement
Clinikally may, in its sole discretion, alter and amend these terms or any aspect of Elite, including the Terms of Use" and "Privacy Policy" on the Purplle platforms, without any notice to members. You are required to visit the website from time to time and be informed of any changes in these terms and conditions.
Termination
Clinikally may terminate the "Elite" membership of a user, at its sole discretion, without provision of notice, the event that the Elite member engages in conduct that violates these terms or any applicable law, or involves fraud or misuse of the Elite membership, or is harmful to the interests of Clinikally or any other service on the Clinikally platform.
